PUBLIC HEARINGS

 

ITEM ONE:  CASE# 09-00800001:  Request by Martin Guillen, property owner, for a variance from Section 10-4B-1(D) of the Gallup Municipal Code regulating side yard setbacks.  Applicant is requesting a variance of three feet (3’) from the required five-foot (5’) side yard setback on the west property line for a proposed manufactured home.  The property lies within the Multiple-family Residential-mixed Use (RM-4) District, located at 1010 West Princeton Avenue (unimproved portion).

 

ITEM TWO:  CASE# 09-00300001:  Request by Dan Terlecki of Basilio Apartments Limited Partnership, property owner, for final plat review of Replat #1 of Lot 5, Colaianni Subdivision.  The request is for a replat in order to dedicate 0.3644 acres in the southern portion of the property adjacent to Peretti Wash to the City of Gallup as City Right-of-Way.  Said property contains 5.294 acres within the Multiple-family Residential-mixed Use (RM-4) District and is located at 350 Basilio Drive.

 

ITEM THREE:  CASE# 09-00300002:  Request by Joe DiGregorio of Six D., Inc., property owner, for final plat review of Replat #1 Lots 1 – 40, Block 15, I.H. Ford’s Highway 66 Addition.  The request is for a replat in order to dedicate a portion of Lot 20 on Ford Drive as Right-of-Way to the City of Gallup for a turning lane.  Said property contains 2.71 acres within the Heavy Commercial (C3-A) District and is located at 1120 East Highway 66. (N.M. 118).

 

ITEM FOUR:  CASE# 09-01100002:  A resolution voiding an approval of a subdivision and subdivision agreement by the Gallup Planning and Zoning Commission on November 12, 2008. The subdivision request was withdrawn by the applicant due to changing circumstances prior to recording of the subdivision plat and subdivision agreement at the McKinley County Courthouse. Because the subdivision plat and subdivision agreement were not recorded at the McKinley County Courthouse the subdivision is invalid therefore the prior approval must be made void by the Planning and Zoning Commission.
